Being sick in body, & of perfect understanding & memory according to my measure, I make this my last will & testament. My will is, that my deare & afflicted wife, Margaret Cheiney, be carfully & sufficiently provided for during the time of her life, & to that end my will is, that she have all the rents & proffitts yearely, & every years, during the afresayd tearms, of all my houses, lands, & orchards, that I die possessed of, wither in Roxbury, Boston, or els where, except such part of my lands or estate which I shall here after in this my will dispose of to my children or otherwise, which estate bequeathed by me unto my sayad wife, it is my will, that she enter upon & be possessed of immediately after my decease (to witt) the present cropp upon all the land & the use of all my household stuffe & goods, my debtts & funerall expenses being in the first place with all convenient

speed fully discharged; & for my wifes more comfortable being, my desire is, that one of my executors may live in my house in Roxbury, with her, to injoy the housing & lands by the yeare which I have as is aforesayd given unto my wife, upon such equall termes as my other executor & overseers shall agree with him for, but in case both my executors see cause to refuse to accept of this motion in answer to my desire herein, then my will is, that it be let

outt by my executors & overseers to the best advantage for my wife comfortable maintenance. When all my debts & Legacies are discharged out of my stock & husbandry utensills, as cartts, plows & such like, what remaines of my stock afterwards, my will is, it be let out or disposed of for my

wifes use by my executors, with the advice of my overseers; And my will is, that all my moveables be for my wifes use during her life, except what is before disposed. And in case what is above expressed be not sufficient for the comfortable maintenance of my wife, then my will is, that the house at Boston be sold & improved for her further & better supply. I bequeath unto my sonne, John Cheiney, all that land both Aeirable & pasture lying on the east side of the great lotts, being with in the great lotts, being twenty accres, more or lesse, being nowe in the possession of the sayd John. Allso, I give to my sayd sonne, a percell of meadow in the fresh meades being two accres, be the same more or lesse, as it lyeth on the south of a ditch made to dreine the sayd meadow. Also I give unto him one accre of salt marsh, be it more or lesse, as it lyeth bounded with a creeke next the marsh of John Bowles, formerly Isaack Heaths. Also I give unto him eitht accres of land, mor or lesse, lying neare the house of William Hopkinns, All & every of these percells of lands my will is, that my sayd sonne John, be possessed of immediately after my decease. I give to my sonne, William Cheiney, all my land lying in Medfield, lately in the possession of my sayd sonne, upon this condition or promise, that he & his wife, Deborah, be reconsiled & live together in Meedfield or ells where to the satisfaction of John Wiswall, of Boston, & Deacon Parke of Roxbury, but not in Providence or that Jurisdiction; provided allso, that what either my selfe or Deacon William Parke have allready payd, or doe stand ingaged for unto the Court in his behalfe, be first repayd & fully discharged by him, his heirs, or assignes; but otherwise, if my sayd sonne neglect or refuse to accept it with these provisoes, then my will is, that twenty pounds be payd to John Wiswall of Boston, out of my estate. To sonne, Joseph Cheiney, £60 (to witt) my land lying in the third devission, being thirty seaven accres, more or lesse, & twenty pounds to be payd to my sayd sonne, Joseph, out of my stock. My will is, that my three daughters (to witt) Ellin, Margret & mehitobell, have each of them £10 payd to them out of my stock. After my wifes decease, my will is, first that all my houses & lands in Roxbury undisposed of before by this will, I doe give unto two sonnes of my eldest sonne, Thomas Cheiney (to witt) his sonne, Thomas, & his sonne, William to be improved for their beniffitt by ther father untill they are 21 years old, then to be injoyed by them. What remaines of my estate after my wifes decease wither in stock or otherwise, in housing or lands (in any other towne) or estate in any kind undisposed of by this my will, My will is, that one halfe of it be given to my sonne, Joseph Cheiney, & for the other halfe thereof, my will is, that it be Devided into four equall parts, & so dispose of it to my sonne, John Cheiney, & to my three aforesayd daughters, to each of them an equall portion thereof. I Margrat Burges widdow now living in Boston being at present of sound mind memory and reasonable understanding, praised be ye Lord do make this my last will and testmt in manner and forme following

 

That is to say, First I give my precious soul into the hands of my heavenly Father and dear redeemer and my body to bee desently buried according to ye good discretion of my herafter named executor, in hope of a blessed resurrection att ye last day.

He was born on 09 Jul 1721 in Plympton, Plymouth Co, MA. He died before Apr 1775 in Connecticut.

 

Notes for William Curtis:

 

William and Mehitable (Amidown) Curtis removed from Oxford, Massachusetts to Ashford in Windham County, Connecticut early in their married life. The birth of their son Francis is recorded

 

in the Ashford records on 15 Jul 1743, eight months after their marriage. On 20 Apr 1744, William bought 45 acres in Ashford from Henry Amidown, Mehitable's father, at which time William was called "Late of Oxford Now of Ashford" (Ashford LR D:57). This land was taken from the south portion of Henry Amidown's home farm.

 

Between 1743 and 17 Aug 1750, William and Mehitable had four children whose births were recorded at Ashford: Francis, Ransom, Susanna and Henry. Mehetable Curtis, the wife of Mr. Curtis, was admitted to the Ashford Church on 3 Dec 1749. Francis, Ransom and Susanna, the children of William Curtis, were then baptized on 19 Dec 1749 (Ashford ch recs at 43). Henry, son of Mr.

 

Curtis, was baptized on 26 Aug 1750 (Ashford ch recs at 44) and Mehitable, daughter of _______ Curtis was baptized on 18 Aug 1760 (Ashford ch recs at 53).

 

Prior to 1750, William acquired two small tracts from the town of Ashford and another small lot from William Smith, all three of which parcels were in the area of Ashford known as

 

Corbins Claim (LR A:451 & 452). On 20 Jan 1757, William Cortiss, Job Tyler and David Millard dedicated a road through their land, connecting the road from Philip Eastman's to the lead mines and the road from Samuel Knox's to Ebenzer Abbe's. Cortiss's land was in the middle between Tyler and Millard (LR K:207).

 

It is not clear just when William and Mehitable Curtis died. William never acknowledged the road deed he made in 1757, although the other two grantors did so in Dec 1760 and May 1761.

 

Mehetable Curtis bought land from Joseph Amidown in her own name on 21 Apr 1760 (LR K:211), which she sold with full warranties

 

but without the participation of a husband on 3 Jul 1764 (L:119). Certainly William must have been dead by April 1775, when his son Henry became the guardian of what appear to be William's two youngest children. The transactions between 1760 and 1764 might suggest that William was dead by then, but a William Curtiss witnessed a 15 Sep 1772 deed by Francis, Ransom and Henry Curtiss of about 40 acres in the north part of Ashford (LR 11:87). It is

 

difficult to explain who this William was if he was not the father of the grantors.

 

The Mehitable Curtis baptized in 1760 is considered a part of this family on the basis of her mother's membership in this church, the fact that she appears to have been named for her mother, and a guardianship record, dated 4 Apr 1775, in which Henry Curtis of Ashford "Now Elected Chosen and Appointed

Guardian to Mehitable Curtice A Minor of the Town Ashford" gives his bond as guardian (wtns: Ebenr Grosvenor & Stephen Brown Jr; Pomfret Probate Dist., File # 1347). An Asa Curtis of Ashford was also the subject of a bond proceeding in 1775. (Pomfret Probate Dist., File # 1344)

 

Whether she is the same Mehitable who married Joseph Flower on 19 Nov 1783 in Wethersfield is less certain. My information

 

to this effect was received from Jean McNutt. She indicates that Harlow D. Curtis felt that the Mehitable of Wethersfield was a daughter of "Henry and Mehitable Amidon Curtis of Ashford," presumably an erroneous reference to William and Mehitable. Mrs. McNutt and others tentatively accepted this conclusion as there are no other Mehitable Curtises in the Barbour Index of about the right age to be the wife of Joseph Flower, b. 1763. Mrs. McNutt has the children of Joseph and Mehitable Flower as Hannah, Harriet, Mehitable, Emily, Martha, Armenia, Lorenzo Dow and, perhaps, James. None of these appear to be Curtis family names. Ashford and Wethersfield are about 25 miles apart and there was a sizable Curtis family (descended from a Thomas, b. 1598) that settled in Wethersfield as early as 1639. As the births noted in

 

the Barbour Index are far from a complete listing of those that occurred in Connecticut (setting aside the possibility that Mehitable originated outside that state) and there is no known

connection between other members of the Ashford Curtis family and Wethersfield, I feel that the identification of the Ashford

 

Mehitable as the wife of Joseph Flower needs further verification before it can be accepted.

 

Asa Curtis is included as a child in this family solely on

 

the basis of Henry Curtis having also given bond as his guardian on 4 Apr 1775 (with the same witnesses as witnessed the bond of Henry as guardian of Mehitable). The probate file contains a certification of Nathaniel Child, Justice of the Peace, that Asa Curtice of Ashford, a minor, has appeared before him and made choice of Henry as his guardian. (Pomfret District probate packet no. 1344)

Notes for Ransom Curtis:

 

His will was presented for probate in Tolland County Dec. 17, 1829. In it he mentions his late wife, also his present wife, Sarah, and all of the children listed below except for Alice who presumably was deceased. Each received $1 except for William who was to receive the house and land after "paying to my beloved wife Sarah Curtis the full amount of a "Jointer" which my said wife and I made before our marriage." His son, William Curtis, was named executor of the will which was made Feb. 12, 1821, and witnessed by Joseph Parker, Oliver Holt and Jonathan Weston.

The family consisted of two males of 16 years and upwards, four males under 16, and the females.

 

Born in Ashford, but moved to Wellington, Connecticut later. He was married in Willington, Tolland Co., Conn on Dec 8, 1768. Resided in Ashford and in Willington. in 1790 census he lived in Willington, and his will was probated in Tolland Co., Dec 17, 1829. His son Asa was baptized at the Second Congregational Church of Ashford Conn. on July 17, 1785. Ransom and wife joined church at Westford, Connecticut in 1779. They were dismissed and recommended to the Church of Christ at Wellington, Connecticut on April 21, l805.

 

The National Archives has a file on Ransom Curtis who served in Ely's 3rd Conn Regt in the Revolution, the card saying "Minute Roll" of Capt Pain Convers' Co. in Colonel John Ely's Regiment from the State of Connectucut. Archives index # 1411. (Does this indicate he was a Minuteman?) I really believe this must be "our" Ransom because he must have been named for his grandmother's maiden name. She had only one son, William, who must have named Ransom for his (William's) deceased mother's maiden name. I believe there were no other Ransom Curtises the right age for the Rev. service.

He served in the War of 1812 and from data on file at the National Archives, Washington, D.C. we find that he married, first, Mary Venn, who died in 1836 at Painesville, Lake County, Ohio.

 

As his second wife he married on January 1, 1839 at Chardon, LaGrange County, Ohio, Elizabeth, widow of Henry Winter.

 

According to the index to the 1840 census for Ohio he was living in Madison township, Lake County at that time.  Sometime before 1850 the family moved to Portage township, St. Joseph County, Indiana, and in the census of that year was enumerated as Ransom, age 55, farming, b. Conn.; Elizabeth, b. N.J., age 49; Andrews I., b. N.Y., age 16, occupation teaming; and Nelson.

Notes for Francis Curtis:

 

The births of the first four children of Francis and

Elizabeth are recorded in Ashford, the last of which was born in 1778. It was presumably soon thereafter that they removed to Partridgefield, now Peru, in Berkshire County, Massachusetts. Francis appears in the 1790 census for "Partridgetown" with a household of 3 males 16 years and more, 2 males less than 16 and 4 females. (publ. version, p. 31) He is in the 1798 Massachu-setts and Maine Direct Tax Census as having a log house and 200 acres. (vol. 20: Dist. 6, 9th Div., No. 3)

 

Francis served 10 days of military service in the Revolu-tionary War (from 28 Oct 1781) on an alarm to the northward, by order of General Fellows, as a private in Captain James Pierce's Co, Colonel Asa Barns' (Berkshire Co) Regiment.

 

Notes in the handwriting of Mrs. Lottie B. Morris (probably from about 1907) state that Francis and Elizabeth removed from Berkshire Hills, Berkshire County to Middlebury, New York about 1802 or 1803. She indicates that all the children (she lists a Delilah, but no Deliverance) came from Massachusetts about the same time except Sally, who married in Massachusetts and lived and died there.

 

Mrs. Martha Beardsley (1827-1912) stated, in a letter dated 7 June 1907 that:

 

Amasa & Calvin owned consecutive farms on east side of Oatka [Creek.] Comfort owned 2nd farm south of Amasa. Oliver with his father took a farm on west side of Oatka [Creek], which has later years been owned by Hezakiah Miller & heirs. Francis died there, do not remember to have seen him, but remember Grandmother.

 

Francis must have been a religious man, judging by the considerable language in his will concerning his hopes for heavenly reward. Francis, Oliver, Betsey, Polly and Hannah Curtis were all members of the First Baptist Church of Middlebury in 1810. Francis's will was made on 14 Aug 1826 and bequeaths one cow and all Francis' household furniture, beds, bedding and clothing to his wife Betsey. The remainder of his estate is

 

given to his osn Oliver Curtis on the condition that Oliver maintain and provide for Betsey during her natural life. Oliver Curtis to be Executor. Witnesses were Joseph Bisbey, Thomas White and Zenas Owen. The will was proved on 4 Dec 1828.

 

During the revolutionary War he served for 10 days as a private in Capt. Joseph Pierce's Co., Colonel Asa Barns' (Berkshire Co.) regiment, enlisting Oct. 28, 1781 and marching by order of Gen. Fellows on an alarm at the Northward.

 

Sometime after 1800 he had removed from Massachusetts to Genesee County in western New York State in the part set off as Wyoming County in 1841.

 

Marilyn M M Sobotka's email indicates Francis died in Middlebury township, Wyoming, NY, this is in contrast to .

He married Rhoda Rider of Willington, Conn., Nov. 14, 1793 and he is said to have married, secondly, a Dutch girl, Joanna Unknown.

 

In 1803 Rhoda Curtis was dismissed from the church at Willington to the Church of Christ at Cambridge, Washington Co., N.Y., but the family does not appear to be living there at the 1810 census.

 

According to Reference Joseph went to Canada, then to Lee, Oneida.County, N.Y., and finally to Painesville, Lake Co., Ohio where he died on Dec. 3, 1852. His wife, Joanna, died June 14, 1862. However. only one Joseph Curtis is listed in Lake County, Ohio in the index to the 1850 census index and this person is his son of the same name.

 

The births of the first three children are recorded in Willington,, Conn.

Listed in the census at age 55 and born in Connecticut. His occupation was recorded as farming.

 

He served in the War of 1812 and from data on file at the National Archives, Washington, D.C. we find that he married, first, Mary Venn, who died in 1836 at Painesville, Lake County, Ohio.

 

As his second wife he married on January 1, 1839 at Chardon, LaGrange County, Ohio, Elizabeth, widow of Henry Winter.

 

According to the index to the 1840 census for Ohio he was living in Madison township, Lake County at that time.

 

Sometime before 1850 the family moved to Portage township, St. Joseph County, Indiana, and in the census of that year was enum-erated as Ransom, age 55, farming, b. Conn.; Elizabeth, b. N.J., age 49; Andrews I., b. N.Y., age 16, occupation teaming; and Nelson A., b. Ohio, age 10.

             Ransom Curtis died on February 3, 1879 at So. Bend, Ind. His widow, Elizabeth, was living in May of that year, and was of age 76.

 

        ii.       JOSEPH CURTIS was born on 05 Feb 1796 in Willington Hill, Tolland Co., Connecticut. He married LOUISA RYDER. She was born in 1799 in Tolland, Tolland

The family has not been identified in Painesville, Ohio in either the 1860 or 1870 census schedules. The Compiler has no further record of him. The list of

He married March 30, 1830 in Pleasantville, Venango Co., Penna. Laura Merrick, who was born Nov. 4, 1803, also in Willington. After marriage they removed to Chautauqua Co., N.Y. where he was a teacher in the city schools of Buffalo.

 

About 1843 the family removed to Indianna and later, for his health, he went to California in 1851, returning sixteen months later. Reference [FC142] also states that William joined the Pike's gold rush In the summer of 1860, when he was 58.

 

Then in 1861 he removed to Nebraska where he died in Adams, Gage Co. on Mar. 17, 1879, and his wife on Sept. 2, 1885. Both are buried in Highland Cemetery, Adams.

 

iii.      HORACE CURTIS was born on 09 Feb 1804 in Willington Hill, Tolland Co., Connecticut.

Oliver Holt Curtis of Willington married Emily Hills of Tolland. Conn. on Nov. 14, 1837, Abram Marsh officiating [FC117, Tolland, III: 36]. She was the daughter of Leonard and Mary (Ladd) Hills, born Ellington, Conn.

 

They removed to Amherst, Hampshire Co., Mass. where at the 1850 census the family was living with relatives of Oliver's wife. It consisted of Samuel Hills, age 52; Mary Hills, age 75; Oliver Curtis, age 39; Emily, age 39; Chiara, female, age 9; Emily A., age 4, and Frank, age 1. The adults were born in Connecticut; the children in Massachsuetts.

 

At the 1870 census, Amherst, it consisted of Oliver H., age 59, farmer; Emily, age 59; Charry, age 29, teacher; Emily, age 25, no occupation; Frank, age 21, works on farm; and Samuel Hills, age 72, farmer.

 

Emily H. Curtis died at Amherst on March 27, 1888. The remainder of the record is lost, a part of the first few pages of the volume being destroyed.

 

Oliver H. Curtis [sic] died at Amherst on Feb. 27, 1889, age 77, of apoplexy and carcinoma. He was a widower; b Willington. Conn.; father William Curtis, birthplace unknown; mother Mary Holt, b. Wallingford, Conn. He was buried in Amherst, Mass.

 

vii.     WILSON WHITNEY CURTIS was born on 25 Mar 1813 in Willington Hill, Tolland Co., Connecticut. He died on 10 Aug 1890 in Willington Hill, Tolland Co., Connecticut. She was born about 1813. She died on 13 Feb 1887 in Willington Hill, Tolland Co., Connecticut.

 

Notes for Wilson Whitney Curtis:

 

At the 1850 census, Willington, he was listed as age 37, in the family of his parents. Also in the family was a Sarah H. Curtis, age 44, presumably his sister, and Mary, age 8. The relationship of the latter to the others is unknown to the Compiler [02]. Could she be a daughter of Wilson's by an early marriage?

 

There is a record of marriage [FC117, Willington, D:55] of Wilson H. Curtis to Sally Eldridge, both of Willington, on Feb. 12, 1852, the Rev. D. Bancroft officiating.

 

Listed in the 1870 census for Willington, Conn. are William [sic], age 57, farmer, and Sallie, age 57. "William" is probably a census- taker's error for "Wilson". The latter name does not appear in Willington in the census of that year.

 

Gravestone inscriptions in the Willington Hill Old Cemetery [FC056, LXVII:65] read: "Wilson W. Curtis died Aug. 10, 1890, age 77, Sally, his wife, died Feb. 13, 1887, aged 74".

 

viii.    SELDON CURTIS was born on 01 Dec 1815 in Willington Hill, Tolland Co., Connecticut. He died on 18 Feb 1902 in Tolland County, Connecticut. She was born about 1820. She died on 21 Oct 1852 in Tolland County, Connecticut. She was born on 14 Mar 1822. She died on 21 Sep 1892 in Tolland County, Connecticut.

Selden Curtis has not been identified In the 1900 census [SOUNDEX Edition] in Connecticut.

 

Listed in the census at age 34 with occupation shoemaker. Listed in the census at age 60 and occupation farmer.

 

Seldon married as his second wife Martha A. Skinner on June 3, 1853 at Westwood, Conn., the Rev. Ezekiel Skinner officiating [FC117, Ashford, V:110].

 

At the 1870 census, Bolton, Tolland Co., Conn., the family consisted of Selden, age 60, farmer; Poly, age 67, and George, age 21, works on farm.

 

A gravestone inscription also in the above mentioned cemetery, reads, "Martha Aurelia, wife of Selden Curtis. March 14, 1822 - Sept. 21, 1892" [FC056, LXVII,65]. His gravestone inscription reads, "Selden Curtis, Dec. 1, 1815 - -Feb. 18, 1902".

I do not know Abigail's maiden name, She was Mrs. Wallace when she married Asa Curtis in Warren, Pa. She had a daughter, Eliza.It is believed that Abigail was the widow of Caleb Wallace, who was the first murder victim in Warren Co., Pa. Abigail was born in New York about 1796.

 

Abigail Was a member of First United Methodist Church in Rock Island, Illinois in 1836. Her husband, Asa Curtis, was not a member with her, but Morgan Ferguson was. "Anderson Co. Kansas Family Stories & History" by Anderson Co. Historical Soc. states that Eliza Vester Furguson's mother was Abigail Curtis, wife of Asa Curtis.

 

Abigail and Asa lived in the Morgan Furguson home in Rock Island in l850. In the l860 census, Abigail and Asa Curtis , the latter listing himself as

 

a "wagonmaker"lived in Camden Mills (later Milan), Illinois.  Abigail moved from Milan, Illinois to Kansas about l870 where Morgan and Eliza Furguson had moved about 1869.

Wellington W. Curtis came to Illinois on June 2, l836. Commenced running as a teamster on the Mississippi River about 1839. Continued this about seven years. Was in Mexico at the time of the Mexican War. Spent 2 years in Minnesota as a lumberman at some time in the l840's. (Reference: l877 History of Rock Island Co.)

 

After marriage in Rock Island County in 1851, Wellington farmed a farm in Bowling Township, Rock Island Co., Ill. which he purchased from his step-sister's husband, Morgan Furguson. His family of nine children were born on raised on this farm, where Wellington died of Parkinson's Disease in 1889.

i.        WILLIAM10 CURTIS was born on 08 May 1852 in Bowling Twp., Rock Island Co., Illinois. He died in Harlan, Iowa. He married Alice Unknown in Iowa. She was born about 1856 in Iowa.

 

Notes for William Curtis:

 

He died young, probably in the 1880's and probably in Harlan, Iowa. He was married after he moved to Iowa.

He had a son LeRoy Wellington Curtis, and probably another son who died as a young child.

 

His son, LeRoy Curtis lived in Des Moines, Iowa, and in later life married Claire VanGalder of Rock Island, Illinois. They had no children.

 

LeRoy was an employee of the Des Moines Transit Co. for 47 years. LeRoy died at age 81 on July 30, 1962 and was buried at Harlan, Iowa.

                      Notes for Robert James Curtis:

 

                      Went to Iowa in 1882 and lived in Shelby Co. across the county line near Walnut, Iowa. Was said to have owned a lot of land at one time.

 

                      Married Ida Smith, who was a niece of his sister-in-law Mrs. William Curtis.

 

                      Had an only son, DeWitt, who mismanaged the family fortune after his father became old and senile.

 

                      It is believed that Robert Curtis then died in the poorhouse.

 

                      His son DeWitt was unmarried and penniless in a southern state, maybe Texas? when he was last heard from around 1940.

 

                      His obituary in the Harlan weekly newspaper told of his reversal in fortune, and said he had been a man of excellent character and was highly

                      respected by all who knew him. Listed in census at age 22.

 

                       iii.   EMMA CURTIS was born on 11 Jan 1860 in Bowling Twp., Rock Island Co., Illinois. She died on 05 Feb 1927 in Colorado. She married Seth W. Slater on

                              23 Feb 1881. He was born on 14 Apr 1859 in Perryton Twp., Mercer Co., Illinois. He died on 24 May 1929.

                     After marriage husband farmed in Rock Island and Mercer counties in Illinois. About 1904 moved to Colorado, where their son Lee remained

                     and lived near Longmont.

 

                     About 1914 moved to Cedar Falls, Iowa where their daughter Lida was married.

 

                     About 1916 moved to Milan, Illinois. They were visiting in Colorado when she died in1927.

"From the indices to the various census records it appears that Comfort Curtis was living in Berkshire Co, Mass in 1800, then moved to Middlebury, Genesee Co, NY (in the area that was set off as Wyoming Co in 1841), where he is listed in the 1810, 1820, and 1830 census schedules."

 

Comfort is listed in the 1798 Massachusetts and Maine Direct Tax Census with a log house and 100 acres in Partridgefield (now Peru), Berkshire County, Massachusetts. Mrs. Martha Beardsley (1907) indicates that Comfort removed to Middlebury, Wyoming County, New York, where he settled on a farm on the east side of Oatka Creek. In 1810, he is listed in the census for Warsaw, Genesee (now Wyoming) County, New York.

 

By will of 17 May 1831, Cumfort bequeaths several tracts of land and part of his home farm to his wife Priscilla and his youngest son Spencer L. Curtis, Spencer to have the whole after the death of Priscilla. Three tracts were involved (two were of 6 and 32 acres and the last including part of his home farm), all in Middlebury on the east side of Allens Creek bounded by the lands of Lyman Howard, Oliver Curtis and Levi Curtis. The remainder of Cumfort's land he wished divided among his three eldest sons and three daughters. Priscilla Curtis and Cumfort's brother Oliver were named Executors. Witnesses were John Higgins, Hosea Fisk and Truman Fisk.

 

By codicil of 4 June 1831, however, Cumfort indicated that Spencer and Cumfort's eldest son Cumfort should divide all his lands after the death of Priscilla and that Cumfort's other heirs should not share in his estate. Witnesses were John Higgins, Ezra Smith and Truman Fisk, all of Middlebury. The will was proved on 29 August 1831.

 

Oliver Curtiss swore on 29 Aug 1831 that Priscilla Curtis was the widow of Cumfort Curtis and that his children were Ransom Curtis and Sally Goodrich of Chautauqua County and Cumfort Curtis, Levi Curtis and Caroline Cronkite, all of full age and residing in Genesee County, and Polly Curtis and Spencer L. Curtis, who were minors residing in Genesee County.

 

Comfort Curtis of Middlebury executed a will dated June 17, 1831 with a codicil of June 4. 1831. This was filed in the Surrogate's Office, Genesee Co., N.Y. and proved Aug. 29, 1831. The will named as heirs his widow Priscilla, his eldest son Comfort Jr., and sons Levi and Spencer L., a minor. Also named were a daughter, Sally, wife of Peter Goodrich of Chautauqua Co., N.Y., Caroline wife of Tunis Cronkhite of Genesee Co., N.Y., and Polly Curtis, a minor, together with his brother Oliver Curtis.

               He died on 14 Nov 1888 in Myron, Allamakee Co, IA.

 

         iii.   RANSOM B. CURTIS was born on 20 Aug 1803 in Middlebury, Genesee Co, New York. He died on 16 Apr 1876 in Sugar Grove, Warren Co, PA. He married

                BETSEY WELLS. She died about 1840 in Buste, Chautauqua Co, NY. He married MARY PRATT. She was born about 1816 in New York. She died before

               1880 in Sugar Grove, Warren Co, PA.

 

        iv.     LEVI CURTIS was born on 19 Aug 1804 in Peru, Berkshire Co, MA. He died on 23 May 1867 in Middlebury, Wyoming Co, New York (Warsaw Village

                Cemetery, Wyoming Co, NY). He married Climena Priscilla Roberts on 16 Mar 1826 in Middlebury, Genesee Co, New York. She was born about

                1807. She died between 1860-1870 in Middlebury, Wyoming Co, NY.

 

v.       ELIZABETH "BETSEY" CURTIS was born in Middlebury, Genesee Co, New York. She died in Jul 1810 in Middlebury, Genesee Co, New York.

 

vi.      LYMAN CURTIS was born in Middlebury, Genesee Co, New York. He died before 1831 in Middlebury, Genesee Co, New York.
